These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and AnimeSchedule.net ("Company", "we" or "our", concerning your access to and use of the https://animeschedule.net Application Programming Interface henceforth referred to as "API". The website (https://animeschedule.net) as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto will be collectively referred to as "Site". You agree that by using the API, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE API AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms of Use, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the API after the date such revised Terms of Use are posted.
The information provided on the API is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the API from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
The API is intended for users who are at least 13 years old. If you are under 18 (or the age of majority where you live), you may use the API only with the consent of a parent or legal guardian where required by law. By using the API, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Use; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not use the API for any illegal or unauthorized purpose; and (6) your use of the API will not violate any applicable law or regulation.
If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the API (or any portion thereof).
You may be required to create an application (client) on the Site. You agree to keep your secret confidential and will be responsible for all use of your application and secret. We reserve the right to remove, reclaim, or change an application name you select if we determine, in our sole discretion, that such an application name is inappropriate, obscene, or otherwise objectionable.
You will require your end users to comply with (and not knowingly enable them to violate) applicable law, regulation, and the Terms.
You will comply with all applicable law, regulation, and third party rights (including without limitation laws regarding the import or export of data or software, privacy, and local laws). You will not use the API to encourage or promote illegal activity or violation of third party rights. You will not violate any other terms of service with AnimeSchedule.net (or its affiliates).
You will only access (or attempt to access) the API by the means described in the documentation of that API. If we assign you developer credentials (e.g. client IDs), you must use them with the applicable API. You will not misrepresent or mask either your identity or your API Client's identity when using the API or developer accounts.
Automated requests through the documented API endpoints using valid credentials are permitted. You may not scrape the Site, bypass the API, or harvest data outside the limits described in the API documentation.
You may cache API responses only as needed for the normal operation of your API Application. Do not retain user-specific data longer than necessary for the feature that requested it. You may not use API content to train machine learning or artificial intelligence models without our written permission.
We set and enforce limits on your use of the API (e.g. limiting the number of API requests that you may make or the number of users you may serve), in our sole discretion. You agree to, and will not attempt to circumvent, such limitations documented with each API. If you would like to use any API beyond these limits, you must obtain our express consent (and we may decline such request or condition acceptance on your agreement to additional terms and/or charges for that use). The Terms are non-exclusive. You acknowledge that we may develop products or services that may compete with the API Clients or any other products or services.
When a user's non-public content is obtained through the API, you may not expose that content to other users or to third parties without explicit opt-in consent from that user.
You agree to comply with the Site's Terms of Use and Privacy Notice, which may be amended from time to time. Further, you agree to comply with any API Rules found in the official API documentation.
The API is designed to help you enhance your websites and applications ("API Application(s)", "API Client(s)"). YOU AGREE THAT WE MAY MONITOR USE OF THE API TO ENSURE QUALITY, IMPROVE OUR PRODUCTS AND SERVICES, AND VERIFY YOUR COMPLIANCE WITH THE TERMS. This monitoring may include our access and use of your API Application, for example to identify security issues that could affect AnimeSchedule.net or its users. You will not interfere with this monitoring. We may use any technical means to overcome such interference. We may suspend access to the API by you or your API Application without notice if we reasonably believe that you are in violation of the Terms.
You will use commercially reasonable efforts to protect user information collected by your API Applications, including personal data, from unauthorized access or use and will promptly report to your users any unauthorized access or use of such information to the extent required by applicable law.
We do not acquire ownership in your API Applications, and by using our API, you do not acquire ownership of any rights in our API or the content that is accessed through our API.
You will comply with (1) all applicable privacy laws and regulations including those applying to personal data and (2) the AnimeSchedule.net Privacy Notice at https://animeschedule.net/privacy-notice, which governs your use of the API when you request access to AnimeSchedule.net user information. You will provide and adhere to a privacy policy for your API Application that clearly and accurately describes to users of your API Application what user information you collect and how you use and share such information (including for advertising) with AnimeSchedule.net and third parties.
If your API Application accesses user data through OAuth2, you must use only the documented authorization code flow and implement PKCE where applicable. You must register accurate redirect URIs and request only the minimum scopes your application needs (such as animelist or stats).
You must store access tokens and refresh tokens securely and must not expose them to other users or in public client-side code. You must honor user consent and revocation and stop using tokens when a user revokes your application's access.
When you access AnimeSchedule.net user information through the API, you are responsible for compliance with applicable privacy laws and for your own privacy policy. Our Privacy Notice governs the information we provide through the API. You must not expose non-public user content to third parties without that user's explicit opt-in consent.
Unless otherwise indicated, the API is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the API (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, international copyright laws, and international conventions. The Content and the Marks are provided on the API "AS IS" for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the API and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
Content such as anime graphics and user-generated graphics, photographs, video and audio are not owned or controlled by us unless otherwise indicated and do not fall under these terms, but are still subject to their respective intellectual property rights.
Provided that you are eligible to use the API and comply with these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to access the API and use data returned through it solely as necessary to operate your API Application(s). Any commercial or revenue-generating use of the API or Content remains subject to our prior written approval as described elsewhere in these Terms. We reserve all rights not expressly granted to you in and to the API, the Content and the Marks.
You may not access or use the API for any purpose other than operating an API Application in compliance with these Terms. Automated access through the documented API with valid credentials is permitted. The API may not be used in connection with any commercial endeavors except with our prior written approval. As a user of the API, you agree not to:
Developer credentials include application tokens, secrets, refresh tokens, and other private keys. Application IDs or client identifiers may be published in client software, but secrets, tokens, and refresh tokens must remain confidential. You will keep private credentials confidential and make reasonable efforts to prevent other API Clients from using your credentials. Secrets, tokens, and refresh tokens must not be committed to public source repositories or exposed in public client-side code.
Our communications to you and our APIs may contain AnimeSchedule.net confidential information. AnimeSchedule.net confidential information includes any materials, communications, and information that are marked confidential or that would normally be considered confidential under the circumstances. If you receive any such information, then you will not disclose it to any third party without our prior written consent. AnimeSchedule.net confidential information does not include information that you independently developed, that was rightfully given to you by a third party without confidentiality obligation, or that becomes public through no fault of your own. You may disclose our confidential information when compelled to do so by law if you provide us reasonable prior notice, unless a court orders that we not receive notice.
"Brand Features" is defined as the trade names, trademarks, service marks, logos, domain names, and other distinctive brand features of each party. Except where expressly stated, the Terms do not grant either party any right, title, or interest in or to the other party's Brand Features. All use by you of AnimeSchedule.net's Brand Features (including any goodwill associated therewith) will inure to the benefit of AnimeSchedule.net.
API Applications that use the API must include a visible credit or link to AnimeSchedule.net (for example, "Powered by AnimeSchedule.net" linking to https://animeschedule.net). We hereby grant to you a nontransferable, nonsublicenseable, nonexclusive license while the Terms are in effect to display AnimeSchedule.net's Brand Features for the purpose of providing that credit or promoting that you use the API. You must only use the AnimeSchedule.net Brand Features in accordance with the Terms and for the purpose of fulfilling your obligations under this Section. You understand and agree that we have the sole discretion to determine whether your attribution and use of our Brand Features are in accordance with the above requirements and guidelines.
You will not make any statement regarding your use of an API which suggests partnership with, sponsorship by, or endorsement by AnimeSchedule.net without our prior written approval.
In the course of promoting, marketing, or demonstrating the API you are using, we may produce and distribute incidental depictions, including screenshots, video, or other content from your API Application, and may use your company or product name. You grant us all necessary rights for the above purposes.
You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the API ("Submissions") provided by you to us are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. You hereby waive all moral rights to any such Submissions, and you hereby warrant that any such Submissions are original with you or that you have the right to submit such Submissions. You agree there shall be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right in your Submissions.
These Terms of Use shall remain in full force and effect while you use the API. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS OF USE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE API (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OF USE OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE API OR DELETE ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.
If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.
We reserve the right to change, modify, or remove the contents of the API at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our API. We also reserve the right to modify or discontinue all or part of the API without notice at any time. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the API.
We cannot guarantee the API will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the API, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the API at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the API during any downtime or discontinuance of the API. Nothing in these Terms of Use will be construed to obligate us to maintain and support the API or to supply any corrections, updates, or releases in connection therewith.
The API is versioned (for example, v3). Breaking changes may occur between API versions or within the same version. Material changes to the API will be documented in the official API documentation changelog. Deprecated API versions or endpoints may be discontinued after notice through the API documentation, as with previously discontinued versions.
There may be errors or omissions in API responses or documentation, including field descriptions and deprecations. We reserve the right to correct errors and update API data or documentation at any time without prior notice.
THE API IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE API AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE API AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE API'S CONTENT OR THE CONTENT OF ANY WEBSITES OR APPLICATIONS LINKED TO THE API AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, (2) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (3) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE API, (4) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE API BY ANY THIRD PARTY, AND/OR (5) ANY ERRORS OR OMISSIONS IN ANY CONTENT AND MATERIALS OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT MADE AVAILABLE VIA THE API.
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE API, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US. CERTAIN US STATE LAWS AND INTERNATIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your Submissions; (2) your API Applications; (3) use of the API; (4) breach of these Terms of Use; (5) any breach of your representations and warranties set forth in these Terms of Use; (6) your violation of the rights of a third party, including but not limited to intellectual property rights; or (7) any overt harmful act toward any other user of the API with whom you connected via the API. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.
We will maintain certain data that you transmit to the API for the purpose of managing the performance of the API, as well as data relating to your use of the API. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the API. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.
These Terms of Use and any policies or operating rules posted by us on the Site or in respect to the API constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. These Terms of Use operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Terms of Use or use of the API. You agree that these Terms of Use will not be construed against us by virtue of having drafted them. You hereby waive any and all defenses you may have based on the electronic form of these Terms of Use and the lack of signing by the parties hereto to execute these Terms of Use.
